1. Service Overview

Welcome to UpEarth ("we," "our," or "us"). UpEarth operates as a for-profit service platform app that facilitates real-world environmental impact through tree planting initiatives.

By using our platform, you agree to these Terms of Service. Our service allows users to contribute funds toward environmental efforts, specifically tree planting projects that we fulfill either directly or through reputable and verified reforestation partners.

2. Contributions & Service Disclaimer

Important: While users contribute funds toward environmental efforts (like planting trees), these contributions are not charitable donations under tax law.

  • Our platform operates as a for-profit service that facilitates real-world environmental impact
  • Funds collected are used to fulfill the service of planting trees either directly or via approved reforestation partners
  • We do not issue tax-deductible contribution receipts
  • Your contributions purchase a service: tree planting and impact tracking
  • All payment processing is managed by Polar (checkouts, subscriptions, billing)

3. Service Fulfillment

When you make a payment to UpEarth, you are purchasing a complete carbon offsetting and stats tracking for your planting contributions. We fulfill this service by:

  • Planting trees through our direct operations and verified reforestation partners
  • Providing impact tracking and progress updates
  • Providing carbon offsetting, assessment and impact tracking of your contribution
  • Offering gamified statistics and community features

Each $1 contributed plants one tree, with an estimated annual CO₂ offset of 48 pounds per tree.

4. Payment Terms (Polar)

All payments are processed securely through Polar. Polar handles:

  • Secure checkout and subscription billing
  • Billing and invoicing
  • Refund processing

We do not store credit card or banking information on our servers. Financial data is handled by Polar.

5. User Responsibilities

By using UpEarth, you agree to:

  • Provide accurate account information
  • Use the service for legitimate environmental impact purposes
  • Not attempt to manipulate or abuse our system
  • Respect our community guidelines and other users
  • Comply with all applicable laws and regulations

6. Refunds and Cancellations

  • Recurring contributions can be cancelled at any time
  • One time Refunds are available within 5 days
  • After that, contributions are non-refundable since they are immediately directed to verified reforestation projects
  • All refund requests are processed through Polar

7. Limitation of Liability

UpEarth provides tree planting services to the best of our ability, but we cannot guarantee:

  • Survival rates of individual trees due to natural factors
  • Exact CO₂ offset amounts (estimates based on research averages)
  • Specific planting locations or timing
  • Uninterrupted service availability

Our liability is limited to the amount of your contribution for the specific service period in question.
